What is subletting?
Subletting is a way in which the tenancy agreement holder makes his/her accommodation available in whole or in part to an external third party in the contract, almost always in return for financial compensation. This compensation does not always have a monetary value. Thus, sub-letting can present itself in another form, similar to accommodating an employee of the house in a room leased by his/her employer in return for hours of housekeeping tasks. Sub-letting can be both short-term and long-term and it is not considered sub-letting when the tenant occasionally lives close by.
How do you sublet?
In France, it is legally possible to sublet according to Article 8 of the law of 6 July 1989, under two conditions: to have a written agreement from the owner and the rent of the sublet may not exceed that of the main tenancy. Without this agreement, the tenant's actions are irregular and it may terminate the main agreement and the sub-letting agreement at the same time.
