PREAMBLE

MagicStay, a simplified joint stock company under French law with capitalization at 2,097,806 euros, inscribed upon the Commercial and Trade Register in Grasse under no795 128 248, located at 7 Avenue Michel Chevalier, ZI les Bois de Grasse, 06130 GRASSE, France, registered in the register of travel operators and stays under the following number (Atout France) : IM006170015, (hereinafter referred to as MagicStay), operates the digital platform accessible at the address www.magicstay.com.

The Site offers a broker service allowing professionals to rent furnished property in order to have lodging solutions for short-term stays during professional events (trade shows, symposiums, etc.). Broker service shall be understood as a digital service including:

A service publishing and referencing furnished properties rented seasonally by professional and non-professional users.

An on-line reservation service allowing professional users to reserve a property as well as various ancillary services.

The present BtoB General Terms and Conditions of Service have been agreed between the Professional Supplier and MagicStay (hereinafter referred to collectively as the Parties).

 

IMPORTANT

Any publishing by the Professional Lessor implies acceptance, without reserve of the present B to B General Terms and Conditions of Service.

 

ARTICLE 1. DEFINITIONS

Advertisement: shall be understood as the Content published by the Lessor on the Site describing the furnished property’s characteristics to be offered for rent through the Service.

General Terms and Conditions for Use: shall be understood as the contract binding the User to MagicStay and governing, among other things, using the Site’s functionalities as well as the behavioral standards to be observed when creating Content. The General Terms and Conditions for Use may be accessed at the URL address https://www.magicstay.com/page_109-general-terms-for-use.html.

General Terms and Conditions of Sale: shall be understood as the contract binding the Lessee to MagicStay and governing, among other things, reserving the furnished property offered by the Lessor under the Service framework offered by MagicStay through the Site. The General Terms and conditions of Sale may be accessed at the URL Address https://www.magicstay.com/page_108-terms-and-conditions-of-sales.html

BtoB General Terms and Conditions of Service: shall be understood as the present contract and its Appendices, binding Lessors qualified as a Professional to MagicStay.

BtoC General Terms and Conditions of Service: shall be understood as the contract binding Non-professional Lessors to MagicStay and governing, among other things, Non-professional Lessors’ offering furnished property to a Lessee for rent under the framework of the Service offered by MagicStay through the Site. The BtoC General Terms and Conditions Service and may be accessed at the URL Address https://www.magicstay.com/page_107-terms-of-services---individual-b2c.html.

Content: shall be understood as all information and data communicated by the Users on the Contribution Areas, including all formats and in particular texts, photographs, images, videos, and all other multimedia formats.

Contribution Areas: shall be understood as all digital communication, publication, consultation, exchange, and dialogue areas, organized under various headings which may change, accessible through the site.

Identifier: shall be understood as the e-mail address and password selected by Users when registering that provides for connecting to their Profile.

Information: shall be understood as the information and data communicated by MagicStay on the Site including all formats and in particular texts, photographs, images, videos, and all other multimedia formats.

Rental: shall be understood as renting and reserving a Lessor’s lodgings offered to a Lessee through the Service.

Rating: shall be understood as the ratings awarded on the site in order to help Lessees make a selection.

Heart Rating: shall be understood as the assessment by a User regarding the seriousness of another User or Rental quality using a rating system (with hearts) and a comment drafted in a free comment area

Star Rating: shall be understood as the automated star attribution system using an algorithm that takes into account the lodgings’ equipment and service level as well as ratios.

Lessor: shall be understood as a User publishing an Advertisement in order to offer property for rent.

Professional Lessor: shall be understood as a User who, under the framework of professional activities as defined by applicable law and jurisprudence, publishes an Advertisement. Professional Lessors have accepted the BtoB General Terms and Conditions of Service.

Non-professional Lessor: shall be understood as a User who, as a consumer as defined by applicable law and jurisprudence, publishes an Advertisement. Non-professional Lessors have accepted the BtoC General Terms and Conditions of Service.

Lessee: shall be understood as a User, acting under the framework of professional activity as defined by law and jurisprudence, responding to an Advertisement in order to rent a property or enjoy an Ancillary Service. Lessees have accepted the General Terms and Conditions of Sale.

Ancillary Services: shall be understood as ancillary services that may be offered by Lessors (housecleaning, etc.) to Lessees in addition to the Rental.

Profile: shall be understood as the interface in which all data provided by the User is grouped. This data includes information regarding the User such as e-mail address, personal information, as well as Advertisements, contracts, and where appropriate Rental and Ancillary Service offerings, etc. It is hereby specified that a Profile may not be transferred to a third party.

Reservation: shall be understood as the Rental offered by a Lessor through the service and any Ancillary Services that may be offered by the Lessor

Service: shall be understood as the broker service offered by MagicStay through the Site in order to allow Lessors to offer Rentals and, where applicable, Ancillary Services to Lessees.

Site: shall be understood as the Internet site accessible at the URL address www.magicstay.com published by MagicStay

Users: shall be understood as all persons browsing the Site.

 

ARTICLE 2. SCOPE

The purpose of the present BtoB General Terms and Conditions for Service is to set:

the conditions and modalities for Professional Lessors offering Reservations on the Site through the Service
the financial terms and modalities regarding such Reservations

 

ARTICLE 3. CONTRACTUAL DOCUMENTS

The relationship between MagicStay and the Professional Lessor assumes compliance with thepresent BtoB General Terms and Conditions and its Appendices; General Terms and Conditions for Use of the Site accessible at the address [https://www.magicstay.com/page_109-general-terms-for-use.html].

It being understood that said contractual documents are mutually intelligible. Nevertheless, should there be a contradiction or divergence between the terms of said contractual documents, they shall prevail in the order listed hereinabove.

 

ARTICLE 4. CONTRACT TYPE

The BtoB General Terms and Conditions for Service shall not grant, under any circumstances, the quality of employee, agent, or representative of MagicStay to Professional Lessors.

Moreover, the Parties hereby state that the present BtoB General Terms and Conditions for Service shall not, under any circumstances, be deemed as constituting a legal person or entity of any kind, and that any form of “affectio societatis” is formally excluded from their relationship.

It is hereby specified that Magic Event MagicStay, as a simple technical intermediary, shall not participate, under any heading, in grievances, litigation, or complaints related to executing or interpreting the contracts signed between the Lessees and Professional Lessors unless MagicStay’s legal and/or contractual obligations are called into question.

 

ARTICLE 5. COLLABORATION

The parties shall cooperate in a spirit of close collaboration in order to facilitate the good faith execution of their respective contractual obligations.

Therefore, each Party shall inform the other Party of any event or information of which it becomes aware that may be susceptible of affecting, in any way whatsoever, the execution of its obligations and any difficulties that it might encounter regarding executing the BtoB General Terms and Conditions for Service.

 

ARTICLE 6. Professional Lessor’s Obligations

6.1 OBLIGATIONS REGARDING ADVERTISEMENTS

Publishing an Advertisement assumes that Professional Lessors shall:

communicate information regarding the Rental’s essential characteristics, i.e. the lodgings’ surface area, its geographic address, price, availability, etc. It is hereby specified that such items may be directly imported by Professional Lessors in the form of feeds, in particular using an API or Channel Manager.
The Professional Lessor agrees to select a cancellation policy among those presented in Appendix 1 which will be applicable to the Advertisements and governing rents return dates.

Professional Lessors shall:

take out an insurance policy covering their Civil Liability as well as the lodgings rented through the Site.
bear the expense of insurance formalities, protection, and reporting to competent government services;
ensure compliance of their activity on the Site with applicable legal, regulatory, and fiscal provisions.
Under no circumstances shall MagicStay be held liable for any breach of the abovementioned obligations.

It is hereby specified that MagicStay shall not conduct any prior checks or validation of the Advertisement’s content published on the Site or of any changes made to changeable settings thereof by Professional Lessors.

Professional Lessors shall be solely responsible for the accuracy of the information provided in Advertisements.

In accordance with the General Terms and Conditions for Use, Professional Lessors declare that the information published in their Content and in particular their Advertisements is sincere and true.

Regarding including photographs in Advertisements, it is hereby specified that they:

may not exceed a size set at 15 megabytes per photo
must be in JPG, PNG, or GIF format.
In order to facilitate Users reading Advertisements, MagicStay has created a Rating system.

Regarding star attribution, this Rating is accomplished automatically according to the algorithm used by the Site.

Professional Lessors may inform MagicStay of a classification or quality indicator provided by an official and/or recognized body by e-mail: support@magicstay.com.

Such classification and/or quality indicator shall then be substituted for the star attribution in the Rating.

 

6.2 OBLIGATIONS REGARDING RENTALS

Professional Lessors shall be notified, in their Profile, of Reservation Requests by Lessees.

From the time of a Reservation request, Professional Lessors shall have a period of twenty four (24) hours to accept or refuse such request.

Professional Lessors hereby expressly acknowledge that by activating the “Immediate Reservation” function, they renounce the period mentioned in the previous paragraph: the reservation is deemed accepted.

Professional Lessors may also set their lodgings to Immediate Reservation in the feeds from the Channel Manger. Under these conditions, they also renounce the period mentioned in the previous paragraph: the reservation is deemed accepted.

Before accepting the reservation, Professional Lessors shall verify:

Rental and, where appropriate, Ancillary Service availability for the relevant period;
The accuracy of the rates mentioned on the Site;
The accuracy of the relevant lodgings’ address.
After verification, Professional Lessors shall accept the reservation.

From such acceptance:

Professional Lessors must comply with the commitments made with regard to the Lessee, in particular regarding the Reservation price;

Lessees shall pay, directly on the Site, the full price indicated in the Advertisement.

MagicStay shall automatically add all service fees to such sum in accordance with the “Remuneration” article herein.

A 24-hour guarantee shall be granted to the Lessee. Thereby, should the Lessee note a significant difference between the Advertisement’s content and reality, he may request, by e-mail, that MagicStay not pay the Reservation sum to the Professional Lessor. In order to be admissible, such request must be supported by testimonials or photos of the issues encountered. MagicStay may then cancel Reservation payment to the Professional Lessor and delete its Profile.

 

6.3 OBLIGATIONS REGARDING RESERVATION CANCELATIONS

A Professional Lessor canceling a Reservation requires:

Informing the Lessee;

Informing MagicStay by sending an e-mail to cancellation@magicstay.com.

All Reservations cancellations by the Professional Lessor must be justified. Failing which, MagicStay reserves the option of deleting the Professional Lessor’s Profile.

The Professional Lessor must then repay the sums received pursuant to the canceled Rental. Moreover, any Reservation cancelation initiated by a Professional Lessor shall be subject to invoicing by MagicStay of an amount equivalent to 18% excluding tax of the overall Reservation amount.

 

6.4 OBLIGATIONS REGARDING MAGICSTAY’S REMUNERATION

6.4.1 SERVICE FEE APPLICATION AUTHORIZATION

Professional Lessors hereby authorize MagicStay, solely by accepting the Reservation request, to add service fees calculated according to the modalities defined in the following article to the Rental price.

 

6.4.2 SERVICE FEE CALCULATION MODALITIES

Service fees are invoiced to the Lessee and rounded up to the next euro.

MagicStay shall be take its remuneration for the Rentals according to the following modalities.

MagicStay’s remuneration shall correspond to a percentage calculated based on the Rental price. The result obtained shall always be rounded up to the next euro.

As of April 1st, 2015, the fees are, by bracket and overnight stay, as follows:

13% excluding tax under €250,

12% excluding tax between €251 and €350,

11% excluding tax between €351 and €450,

10% excluding tax between €451 and €550,

9% excluding tax between €551 and €650,

8% above €650.

Therefore, for example, the Service Fees added to a requested rent of €375 for one night would be:

13% on €250 = €32.50 excluding tax

12% on €125 = €14.64 excluding tax

Total Service Fees: €47.14 excluding tax i.e. €48 excluding tax.

So the lodgings would be offered at €423 excluding tax

It is hereby specified that MagicStay shall not invoice service fees on Ancillary Services (housekeeping, etc.).

 

6.4.3 DISBURSEMENT FEES (Except Serviced Apartments)

Disbursement Fees shall be invoiced to Professional Lessors and withheld from the disbursement payment for Reservations.

MagicStay shall be remunerated according to the following modalities:

 

6.4.4 CHANNEL MANAGER (Except Serviced Apartments)

With regard to advertisements submitted in a feed from a Channel Manager, Professional Lessors shall enjoy special pricing based on the number of advertisements published on the Site:

. 13% excluding tax from 5 to 50 published advertisements

. 12% excluding tax from 51 to 500 published advertisements

. 11% excluding tax from 501 to 2500 published advertisements

. 10% excluding tax from 2501 published advertisements

The published advertisements must be during a maximum period of 2 to 6 weeks in order to enjoy such sliding scale pricing.

Said pricing shall include both Service Fees and Disbursement Fees.

Professional Lessors may break down such Fees as desired between:

Disbursement Fees invoiced when disbursing payments for Reservations

Service Fees invoiced to the Lessee.

Nevertheless, Disbursement Fees may not be less than 2.5% excluding tax.

For example, a Professional Lessor publishing 1000 Advertisements may decide to break down the 11% tax exclusive fees as follows: 6% tax exclusive Disbursement Fees and 5% tax exclusive Service Fees So, for an Advertisement offering lodgings at €100 excluding tax per night, it would be offered on the site at €105 excluding tax and the rent disbursed to the Professional Lessor would be €100 minus €6 excluding tax.

 

6.4.5 SERVICED APARTMENTS

Disbursement Fees shall be invoiced to Professional Lessors and withheld from the disbursement payment for Reservations.

MagicStay shall be remunerated according to the following modalities:

. 17% excluding tax from 1 to 300 published advertisements

. 15% excluding tax from 301 to 3000 published advertisements

. 11% excluding tax from 3001 published advertisements

 

6.4.6 VISIBILITY OPTIONS

For each of the Advertisements published on the Site Professional Lessors may purchase Visibility options.

The Premium option provides for automatically placing the Advertisement at the head of the list, among the Premium Advertisements, and costs €208.33 excluding tax.

The One option provides for automatically placing the Advertisement at the head of the list, among the One Advertisements, under the Premium Advertisements and costs €125 excluding tax.

The “Automatic Calendar Update” option provides for automatically placing the advertisement at the top of its category, “Premium,” “One,” or “Free” once per day and costs €83.33 excluding tax.

 

6.4.7 VAT AND OTHER TAXES

French VAT shall be applied by default to Service Fees and Disbursement Fees. In order to not have such French VAT applied, Professional Lessors must upload the following official documents when registering:

VAT Liability Certificate (or, failing which, a tax residence affidavit)

Intracommunity VAT number,

Certificate of commercial registration.

In certain countries, MagicStay may decide, at its sole discretion, to facilitate Occupancy Tax collection from Lessees and its submission on behalf of Lessors, if the local tax authorities deem that MagicStay or the Lessors have an obligation to collect and submit taxes. In this case, the Lessor hereby requests and authorizes MagicStay to collect the Occupancy Tax from Lessees on behalf of the Lessor at the time of Reservation and submitting such Occupancy Taxes to the tax authorities.

Outside the cities and countries where MagicStay collects said Taxes, Lessors shall remain solely liable for collecting and/or submitting all Occupancy or other Taxes due that may apply to the Rentals.

 

6.4.8 COLLECTION AND INVOICE ISSUANCE MANDATE

Professional Lessors hereby grant a mandate to MagicStay to collect the Reservation price through the Service using the Site’s online payment systems and publish the invoice on their behalf.

The collection and invoicing mandate stipulated in order to facilitate, secure, and centralize Reservation payment shall not exonerate Professional Lessors from reporting obligations under their responsibility, in particular with regard to tax and labor authorities.

The sums due to Professional Lessors shall be paid by MagicStay minus the Disbursement Fees and any Re-marketing Fees MagicStay may incur.

 

6.5 OBLIGATIONS REGARDING THE DEPOSIT

Should a deposit be requested, Professional Lessors shall include it clearly in the Advertisement such that Lessees may be aware of it before making a reservation.

All deposit requests not mentioned in the Advertisement are strictly prohibited; in this manner, Lessees may refuse, among other things, any cash payments requested upon arrival.

 

ARTICLE 7. MagicStay’S OBLIGATIONS

MagicStay shall ensure the security and confidentiality of payments made on the Site.

 

ARTICLE 8. INVOICING

MagicStay shall draw up the invoice regarding the Reservations that have been paid through the Site in the name and on behalf of the Professional Lessor with the latter’s references.

The amount mentioned on the invoice sent to the Lessee shall be that of the sums for which prior direct debit authorization has been obtained.

Professional Lessors and Lessees shall receive computerized invoices regarding their Reservations on their respective Profiles.

 

ARTICLE 9. DURATION AND TERMINATION

9.1 DURATION

The BtoB General Terms and Conditions of Service shall be agreed for an indefinite period from their acceptance by the Professional Lessor

 

9.2 TERMINATION

Without prejudice to the other provisions in the BtoB General Terms and Conditions of Service, MagicStay may close the Profile without prior notice or notification in cases of serious breach by a Professional Lessors of any of its obligations.

Without prejudice to the other provisions hereof, MagicStay may close the Profile fifteen (15) days after sending a Professional Lessor an e-mail signifying the breach and requesting compliance with the BtoB General Terms and Conditions of Service remaining fruitless.

Closure-termination shall take place without prejudice to any damages that may be claimed by MagicStay from such Professional Lessor or its assigns or legal representatives as remedy for the prejudice suffered due to such breach.

It is hereby specified that in such a situation, such Professional Lessor shall not re-register on the Site.

 

ARTICLE 10. RESPONSIBILITY

10.1 WAIVER OF RESPONSIBILITY

MagicStay hereby declines any responsibility:

In cases of temporarily inability to access the Site for technical maintenance operations or updating the published information;

In cases of virus attacks;

In cases of abnormal or illicit use of the Site;

Moreover, MagicStay shall not be held liable for any consequences that may result during or following encounters or contacts between Lessees and Professional Lessors when using the services offered by the Site.

Under no circumstances shall MagicStay be held liable for any lost or altered data, lost profits, sales, time, opportunity, or any other indirect damages, whether said loss or said damage results from negligence or any other cause.

The abovementioned liability limitations shall not apply in cases of deceit or gross misconduct by MagicStay.

 

10.2 Liability Limitation

In any event, and regardless of the circumstances, MagicStay’s responsibility to any Professional Lessor or any other third party, shall be limited to the total amount of Disbursement Fees paid to MagicStay by the relevant Professional Lessor during the month preceding said liability claim.

Professional Lessors shall be responsible for proving MagicStay’s fault in order to call its liability into questions, with the latter being subject solely to an obligations of means, excluding any obligations to achieve results.

Under no circumstances shall MagicStay be held liable for a fault, negligence, abandonment, cancelation, omission, or failure by a Professional Lessor.

 

ARTICLE 11. GUARANTEE

Professional Lessors shall hold MagicStay harmless against all legal proceedings, complaints, claims, or oppositions on behalf of any person invoking a right or act of unfair and/or parasite competition, counterfeit, misleading or unfair commercial practices, or illicit service related to the Reservations.

Professional Lessors shall be responsible for all damages to which MagicStay may be sentenced due, among other things, to an act of counterfeit, unfair and/or parasite competition, or misleading or unfair commercial practice resulting from the performance hereof as soon as the sentence become final, as well as compensation and fees of all kinds outlaid by MagicStay for its defense, including lawyers’ fees.

 

ARTICLE 12. ADVERTISING – COMMUNICATIONS

Professional Lessors hereby authorize MagicStay to freely use the Content without valuable consideration in order to conduct communications operations regardless of media.

 

ARTICLE 13. FORCE MAJEURE

MagicStay reserves the option of suspending, delaying, or modifying Site functionalities should force majeure events or circumstances, or fortuitous events, or events or circumstances contractually assimilated with force majeure or fortuitous events occur even if they do not fulfill the legal definition such as: fire, work stoppage independent and beyond the control of the firm or any suppliers or subcontractors, flood, epidemic, war, requisition, strike, hurricane, tornado, earthquake, revolution, theft of all or part of the equipment, interruption or delay in transportation services, transportation hazards, lack of raw materials, equipment incidents, lack of fuel or any other source of energy, as well as the occurrence of any circumstance or event beyond the control of MagicStay occurring after the BtoB General Terms and Conditions are agreed and preventing execution under normal conditions.

It is hereby specified that, in such situation, Professional Lessors may not claim payment of any compensation and may not file suit against MagicStay.

Should one of the abovementioned events occur, MagicStay shall inform the Professional Lessor as soon as possible.

 

ARTICLE 14. VALIDITY

Should any of the stipulations herein be deemed null and void with regard to an applicable legal or regulatory provision and/or a definitive legal decision, it shall be deemed unwritten but shall not affect the validity of the other clauses which shall remain fully applicable.

In such case, the Parties shall agree to a new provision to replace the one found null and void, it being understood that the new provision shall respect, in so far as possible, the spirit and economic impact on the Parties of the replaced provision

 

ARTICLE 15. MODIFICATION

The BtoB General Terms and Conditions of Service shall be precisely dated and may be modified and updated by MagicStay at any time, in particular in order to adapt to legislative and regulatory changes.

The applicable BtoB General Terms and Conditions of Service shall be those applicable when the Professional Lessors connects to its Profile.

 

ARTICLE 16. JURISDICTION AND APPLICABLE LAW

The present BtoB General Terms and Conditions of Service as well as the relationship between the Professional Lessor and MagicStay shall be governed by French law failing application of another text the Lessor may decide to claim as a consumer.

Should a dispute arise between the Parties regarding the interpretation, performance, or termination hereof, the Parties shall make all due effort to settle the matter amicably.

In case of litigation, the French courts shall be solely competent failing application of another text the Lessor may decide to claim as a consumer.

The fact that one of the Parties has not demanded application of a given clause herein, whether permanently or temporarily, shall not, under any circumstances, be deemed as renunciation of said clause.

Given the nature of their dialogue and in particular their dematerialized relationship, the Parties hereby agree that all computer recordings in MagicStay’s information system shall, in cases of litigation, have probative value.

 

APPENDIX 1

Terms Regarding Paying and/or Canceling Reservations

With regard to the present Appendix, the terms written with an initial capital letter shall be understood as follows:

Re-marketing Fees: shall be understood as the sums corresponding to the costs borne by MagicStay related to re-publishing the Advertisement for the canceled Reservation dates. Such costs represent 4% excluding tax of said Reservation, limited to €120 excluding tax.

Disbursement Fees: shall be understood as the sums corresponding to the costs borne by MagicStay related to disbursing the price paid for the canceled Reservation. Such costs represent 2.5% excluding tax of the price of said reservation.

Service Fees: shall be understood as the sums received by MagicStay from the Lessee. Such costs shall have been defined in the invoice sent by MagicStay to the Lessee.?The terms regarding paying and/or canceling Reservations shall be defined as follows:

Rent disbursement:

The Professional Lessor shall receive from MagicStay 100% of the Reservations within 6 business days following the Reservation, minus Disbursement Fees.

In cases of cancelation by the Lessee:

The sums received shall remain due to the Professional Lessor.

 

Strict

Rent disbursement:

The Professional Lessor shall receive

D-60 days: 50% of the Reserve minus the Disbursement Fees.

D+2 days: the balance minus the Disbursement Fees

In cases of cancelation by the Lessee:

D-60 days or more: the Professional Lessor shall not receive any payment.

D-59 to D-3 days inclusive: the Professional Lessor shall receive 50% of the Reservation, minus the Disbursement Fees and Re-marketing Fees.

D-2 days: the Professional Lessor shall receive 100% of the Reservation, minus the Disbursement Fees and Re-marketing Fees.

 

Moderate

Rent disbursement:

The Professional Lessor shall receive

D+2 days: 100% of the Reserve minus the Disbursement Fees

In cases of cancelation by the Lessee:

D-30 or more: the Professional Lessor shall not receive any payment.

D-29 to D-3 days inclusive: the Professional Lessor shall receive 50% of the Reservation, minus the Disbursement Fees and Re-marketing Fees.

D-2 days and under: the Professional Lessor shall receive 100% of the Reservation, minus the Disbursement Fees and Re-marketing Fees.

 

Flexible

Rent disbursement:

The Professional Lessor shall receive

D+2 days: 100% of the Reserve minus the Disbursement Fees

In cases of cancelation by the Lessee:

D-10 days or more: the Professional Lessor shall not receive any payment.

D-9 days to D-3 days inclusive: the Professional Lessor shall receive 50% of the Reservation, minus the Disbursement Fees and Re-marketing Fees.

D-2 days and under: the Professional Lessor shall receive 100% of the Reservation, minus the Disbursement Fees and Re-marketing Fees.

 

Very Flexible

Rent disbursement:

The Professional Lessor shall receive

D+2 days: 100% of the Reserve minus the Disbursement Fees

In cases of cancelation by the Lessee:

D-3 days or more: the Professional Lessor shall not receive any payment.

D-2 days and under: the Professional Lessor shall receive 100% of the Reservation, minus the Disbursement Fees and Re-marketing Fees.

 

Cancelation by the Lessor

The Lessor must then reimburse the sums received pursuant to the canceled Rental. Moreover, any Reservation cancelation initiated by the Lessor shall be subject to invoicing by MagicStay of an amount equivalent to 18% excluding tax of the overall Reservation amount.
